San Diego is paying $ 1.1 million to two men who sustained serious injuries four years ago when a city water hose knocked them down into a deep ditch pulled by a street sweeper along Moreno Boulevard.
Two men, Raul Ceballos and Israel Mendoza, claim in separate lawsuits that their injuries have diminished their long-term earning capacity. The settlement will also cover medical and legal costs for Ceballos and Mendoza.
The city council unanimously approved the settlement agreement in a closed session in November. The council is due to give final approval to the settlement in open session on Tuesday.
The incident that led to the injuries happened just after midnight on February 16, 2018. City Utility Department workers laid a hose across all lanes of Boulevard Morena in Block 4500 to drain liquid and debris into Rose Creek.
The hose became entangled in a street sweeper that pulled the hose until it knocked Ceballos and Mendoza into a deep trench at the site of an excavation and construction project being worked on by the city and private contractors.
The lawsuits allege that city workers acted carelessly by stretching their hose across the active street. They claim that there was a “foreseeable risk of damage” and that city workers had an obligation to guard the road without danger.
City workers should have known that street cleaners have “low-hanging equipment that often captures or hits objects on the pavement,” according to court documents.
The lawsuits say Ceballos and Mendoza suffered “serious and permanent” injuries, but no further details are revealed in the lawsuits. They also claim that the men suffered emotional pain.
The two lawsuits, filed in 2018 and 2019, were merged in 2020. The trial was due to begin in November, but an interim settlement was reached in September.
The latest settlement comes after the 2020 city audit found that San Diego could significantly reduce the nearly $ 25 million a year it spends on lawsuit payments if it invests in better employee training and deeper risk analysis.
The audit found that San Diego spent a total of $ 220 million over the nine fiscal years, from 2010 to 2018, resolving about 20,000 claims and lawsuits filed during that time.
The auditors also recommended proactive measures such as repairing damaged sidewalks and concrete in key areas and refurbishing dangerous intersections.
The money for the settlement for injuries on Morena Boulevard will not come from the usual source, the city’s public accountability fund. Instead, it will come from the city’s water fund because the employees of the Utility Company worked in that capacity.
